SPARKS® PRO-RATA LIMITED WARRANTY

Sparks Technologies takes great pride in the batteries it manufactures and provides a limited warranty program for many of its batteries. If you purchased an Sparks-branded battery before 10/1/2022, and this PRO-RATA Limited Warranty otherwise applies, subject to the terms and conditions herein, Sparks warrants to the original purchaser that the battery will be free from defects in material and workmanship for the Limited Warranty Period applicable to such battery. If your battery exhibits a defect in material or workmanship, and is covered by this PRO-RATA Limited Warranty, Sparks will reimburse you for any replacement battery you purchase (whether Sparks-branded or otherwise) in an amount equal to a percentage of the original purchase price of the defective battery (not including Core Charges, taxes and any other fees).* No reimbursement will be provided unless original proof of the purchase, replacement battery proof of purchase and a battery test receipt are provided.**

 

How do you tell if a battery is eligible for this PRO-RATA Limited Warranty?

 

Only certain Sparks-branded batteries purchased prior to 10/1/12 are eligible for this warranty. Locate the battery part number on the battery or battery label. Then, look up the battery part number on the attached Pro-Rata Limited Warranty Schedule. Only Sparks-branded batteries with the part numbers listed in the Pro-Rata Schedule are eligible for this PRO-RATA Limited Warranty.

 

What Limited Warranty Period applies to the battery?

 

The part number included on the label on the front of every Sparks-branded battery covered by this PRO-RATA Limited Warranty includes an indication of the Limited Warranty Period (in months). For example, the label for Part #12-36N below indicates a battery with a Limited Warranty Period of 36 months. The Limited Warranty Period can also be determined from the Pro-Rata Limited Warranty Schedule, as explained below.

What percentage of the original purchase price will be reimbursed by Sparks? 

The Limited Warranty Period is made up of two different periods: a full reimbursement period and a pro rata reimbursement period. The length of the two periods can be determined from the attached Pro-Rata Limited Warranty Schedule under the column titled “Warranty (months) Full/Pro-Rata.” The number which comes first represents the number of months in the full reimbursement period and the second number represents the number of months for the total Limited Warranty Period. The pro-rata reimbursement period is determined by subtracting the first number from the second. So, for a battery with a total Limited Warranty Period of 84 total months, and a 30-month full reimbursement period, the full reimbursement period covers months 1 through 30 and a pro-rata reimbursement period covers months 31 through 84. To determine how long the battery has been in service, and whether it is eligible for full reimbursement or pro rata reimbursement hereunder look at your original battery purchase receipt or if the receipt is not available, look at the battery dater punch-out on the label.**

During the full reimbursement period, for any defective battery covered hereunder, Sparks will provide reimbursement for any replacement battery (whether Sparks-branded or not) in an amount equal to 100% of the original purchase price of the defective battery (not including Core Charges, taxes and any other fees).

The pro-rata reimbursement period applies after the full reimbursement period expires, and continues until the end of the entire Limited Warranty Period. To calculate the amount of the reimbursement during the pro-rata reimbursement period, use the following procedure:

 

  1. Look up the battery part number on the attached Pro-Rata Limited Warranty Schedule and identify the amount listed in the “Warranty Cost Per Month”

column. Note: The “Warranty Cost Per Month” has been determined by dividing the “Suggested Retail Price” (not the actual selling price) by the number of months in the total Limited Warranty Period.

  1. Calculate Sparks’s reimbursement amount as follows:
  • First, multiply the Warranty Cost Per Month by the number of months the battery was in service. This is the “Customer’s Responsibility.” Months in service are determined from the original receipt or other proof of purchase, which should match the battery punch-out

 

  • Then, subtract the Customer’s Responsibility from the original purchase price. This represents Sparks’s reimbursement

EXAMPLE:

The punch-out label below is for an Sparks Select 12-36N battery which was purchased in August 2022. The label and Pro-Rata Limited Warranty Schedule indicate a total Limited Warranty Period of 36 months (i.e. until August 2025). The Schedule also shows a 36-month full reimbursement period and a Suggested Retail Price of 25,920. For this example, assume the battery was purchased at its Suggested Retail Price, and was returned in August 2024 (being in service for 24 months).

Since the 12 month full reimbursement period has expired, the pro-rata reimbursement is calculated as follows:
 cost of battery to customer: 29,920/-
cost before taxes & fees :-21,000/-

What procedures should you follow if you have a defective battery?

 If your battery appears defective, please follow the following procedures:

  1. Determine if the battery is not defective, but is simply discharged and needs a Have the battery tested first to determine the cause of failure and retain the receipt of the test results. If the battery is simply in need of a boost, have it re- charged and re-tested. THIS LIMITED WARRANTY DOES NOT COVER MERELY DISCHARGED BATTERIES.
  2. If the battery is still not working properly, determine if the battery is still within the total Limited Warranty Period by referring to the battery’s front label (or the Pro-Rata Limited Warranty Schedule), and checking the date on your proof of The applicable Limited Warranty Period is calculated from the date of sale to the original purchaser.
  3. If the battery is still under warranty, return the battery to an authorized Sparks retailer within the Limited Warranty Period. If an authorized retailer is not in your area, you can submit a claim directly through com or contact Sparks customer support at +91-8658075293.
  4. To obtain reimbursement, provide the authorized Sparks retailer or Sparks (through com) with your proof of purchase for both the defective battery and the replacement battery and a battery test receipt. Allow up to 6 weeks to receive reimbursement.

This Limited Warranty is voided for batteries damaged due to abuse or neglect, including but not limited to the following:

Additional Terms and Conditions:

  • operates (charge or discharge) below or above its authorized temperature range (as measured and logged by the Battery internal data logger),
  • operates at an average temperature exceeding 80°F (27°C) over the life of the Battery (as measured and logged by the Battery internal data logger),
  • is not maintained in accordance with the parameters as set forth in the English language version of the User’s Guide,
  • is charged with a battery charger, charging algorithm or unregulated charge source that does not comply with the Manufacturer’s recommendation as set forth in the English language version of the User’s Guide,
  • is subjected to excess vibration or water entering into battery as might be caused by out of balance or improperly operated pads in floor burnishing machines,
  • data logger is destroyed or altered,
  • manufacturing date codes, safety certification numbers or serial and tracking numbers are destroyed or altered,
  • is disassembled, altered, or repaired by someone other than an authorized Manufacturer’s agent,
  • is not installed with adequate balance of system components,
  • is directly connected to DC motors without proper safety protection, motor controllers, and external motor voltage clamping systems, as recommended below,
  • is not properly protected from inrush currents, as recommended below, or
  • is installed with other makes and/or models in the same
  • Is not to be charged without checking polarity which may cause BMS.
  • improper connection or usage of the CAN bus interface on the Battery as set forth in the English language version of the User
  • Short circuit fire doesn’t hold to warranty condition.
  • This Limited Warranty only applies to batteries purchased from authorized Sparks However, some authorized retailers purchase batteries in lieu of warranty and therefore warranty claims would need to be handled directly through the retailer from which you purchased the battery.
  • Sparks is not responsible for and will not be bound by any additional warranties provided by retailers and does not authorize any other person to make or assume any obligation or liability in connection with any of its

NOTE: This Limited Warranty limits Sparks’s responsibility to providing reimbursement as provided herein, and in no event shall Sparks be liable for monetary damages or other losses arising from any battery defect or failure, including, but not limited to, for any loss of use, time or for any inconvenience or for any incidental or consequential damages. ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE LENGTH OF THE

APPLICABLE LIMITED WARRANTY. Some states do not allow limitations on how long an implied warranty lasts and/or do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. 

* If a Core Charge credit was included in the original purchase price you paid, you will need to return the battery to the original retailer to receive the amount of this credit.

** Proof of purchase includes a receipt, or a credit card or bank statement.

*** Other information, such as battery test results, pictures or a battery label, may also be requested at the time of making your claim.
